Terms and Conditions

1. ACCEPTANCE OF TERMS AND CONDITIONS.

a. These Terms and Conditions (“Terms and Conditions” or “Agreement”) shall be deemed a part of and are expressly incorporated by reference into any and all agreements entered between Sisterly Travel & Events, LLC, [An Independent agency affiliated with WorldVia Travel Network] a North Carolina Limited Liability Company (hereinafter “Sisterly Travel” “we” “us” “our” and any similar derivations) and you the client (hereinafter “you” or “your”).


b. By paying Sisterly Travel the planning fee and/or deposit, you are affirmatively representing that you have read and accept the Terms and Conditions on behalf of yourself and anyone in your traveling party and that you will be financially responsible for the booking. Sisterly Travel is not responsible for your failure to share these Terms and Conditions with anyone travelling with you in connection with services booked through Sisterly Travel.


c. No changes to or deviations from these Terms and Conditions by you will be effective unless they are explicitly accepted in writing by an authorized agent of Sisterly Travel. You acknowledge and agree that Sisterly Travel may change these Terms and Conditions from time to time. Your continued use of our services following such changes constitutes your acceptance and agreement to be bound by said changes. You agree to be bound by the Terms and Conditions in effect at the time of your travel or cancellation.


d. This Agreement commences on the date you place a booking through us and continues for the duration of time Sisterly Travel provides services to you. This Agreement is non-exclusive.


e. You acknowledge and agree that any violation of this Agreement by you may result in cancellation of your booking, reservation, or purchase, forfeiture of any deposit or other monies paid towards said booking, reservation, or purchase, and denial of the applicable goods or services booked, reserved, or purchased.



2. OUR SERVICES.

a. Sisterly Travel (and its affiliated entities) acts as a travel agent only. We sell various travel related products and services (the “Travel Services”) on behalf of numerous transport, travel, and accommodation service and product providers (the “Service Providers”). These Service Providers are independent third parties who are not under the control or responsibility of Sisterly Travel, and we have no special knowledge regarding the financial condition or qualifications of the Service Providers.


b. When you make a booking with Sisterly Travel, you agree that Sisterly Travel will be acting solely to secure any relevant Travel Service offered by a Service Provider. Our obligation to you is to make travel bookings on your behalf and to arrange relevant contracts between you and the Service Provider. The Service Provider and not Sisterly Travel will be responsible to you for the relevant Travel Service, and all bookings are subject to the terms and conditions and limitations of liability imposed by these Service Providers. Any services we provide to you are separate from the actual Travel Services. Your legal recourse for Travel Services is against the relevant Service Provider and not Sisterly Travel, and Sisterly Travel is not responsible for any loss, accident, injury, delay, defect, omission, or irregularity related to or arising out of the Service Provider’s delivery or provision of Travel Services.



3. DOCUMENTATION.

a. It is your sole responsibility to obtain and carry all documents required by applicable government regulations for your itinerary destination(s) including, but not limited to, passports, visas, photographic identification & inoculation certificates, both for yourself and any persons travelling with you. You are solely responsible for confirming the requirements for visas and/or other requirements for admission to your destination(s) by contacting or reviewing information made available by the United States Department of State or representative consulate or government agency of the country to which you are travelling. Be aware that entry to any destination(s) may be refused by government authorities even if the required information and travel documents are complete, and Sisterly Travel is not responsible or liable for any such refusal.


b. It is your responsibility to make certain that you and anyone travelling with you have proper immunizations and documentation before travel. You are also responsible for ensuring compliance with any security or entry rules imposed by any relevant governmental authorities. Sisterly Travel is not responsible for the accuracy of health requirements or vaccination and/or documentation required per your itinerary, and you are solely responsible for identifying and complying with immunization and documentation requirements relevant to your destination(s).


c. To determine documentation requirements relevant to your travel, you and anyone travelling with you should check with the U.S. Transportation Security Administration, the U.S. Department of Homeland Security, and the relevant embassy for your destination(s). For medical and immunization requirements, you and anyone travelling with you should check any travel health notices posted by the U.S. Centers for Disease Control for your destination(s), your local health department, and your medical provider(s).


d. Valid, machine-readable passports are required for all international destinations. Please note that certain destinations will not allow travel if a passport’s expiration date is not within at least six (6) months following the return date of the planned travel. For domestic travel, you are responsible for procuring and carrying all required forms of identification, including any mandated Real ID compliant forms of identification.


e. You are solely responsible for any costs associated with procuring and maintaining any and all required government documents, insurance, or inoculations required for travel, including any visa fees, entry/exit fees, or taxes. Any fines, penalties, payments or expenditures incurred for failure to comply with these requirements will be your sole responsibility.


f. You are solely responsible for ensuring that all travel documents accurately reflect all necessary identifying information, including but not limited to every traveler’s legal first, middle, and last names. You are required to review and verify all aspects of your booking for accuracy, including but not limited to all names, mailing addresses, email addresses, telephone numbers, dates of birth, destinations, travel dates, and accommodations. You must promptly inform Sisterly Travel of any omissions, errors, or corrections regarding your booking, and you voluntarily assume full and sole responsibility for any and all risks and/or costs involved in failing to report such omissions, errors, or corrections to Sisterly Travel.



4. PRICING AND PAYMENT.

a. Price quotes are applicable to the date and time at which they are requested and are current only as of that date. Price quotes are offered in US currency, based on the exchange rates for any relevant respective foreign currency. Exchange rates are subject to fluctuation, and fees or fares may change due to availability, pricing or other factors beyond Sisterly Travel’s control, including but not limited to fuel surcharges, taxes, tariffs, credit card user fees and airfare increases. All prices are subject to change without notice.


b. You may be required to make a deposit toward the cost of our services and such deposits are non-refundable. Any deposit that is made enables Sisterly Travel to hold a reservation for you but is not a guaranty of the price. Final payment is required no less than 30 days prior to departure unless otherwise stated or agreed in writing. Some airfares or services must be paid in full at the time of booking.

d. If you pay for any booked Travel Services via credit card wherein Sisterly Travel acts as the credit card merchant, you agree that: (a) our role is limited to collecting and remitting the payment; (b) that any recourse for a Service Provider’s failure to provide services will be against the Service Provider; and (c) that no chargeback will be initiated by you against us. If Sisterly Travel incurs any costs, including, but not limited to, attorneys’ fees, to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to Sisterly Travel via money order or cash immediately.


e. Sisterly Travel may charge interest on any invoiced amounts not paid within 30 days of the due date at a rate of: (1) 1.5 % per month; or (2) if relevant and binding law governing the transaction requires a lower rate, the highest rate allowable under the law.



5. HEALTH AND SAFETY.

a. A customer’s travel to certain destinations may involve greater risk than others. It is the customer’s responsibility to remain informed on a daily basis as to current news events, travel warnings, travel prohibitions, announcements and advisories issued by the United States or other governments. You expressly acknowledge that travel to any destination(s), including destinations subject to travel warnings or advisories, is at your own risk. You are responsible for ensuring your and any travelling companions’ personal safety while traveling regardless of destination, and Sisterly Travels does not assume any responsibility or liability for your or your travelling companions’ personal security or safety.


b. You are solely responsible for ensuring you are sufficiently healthy and physically fit to engage in any travel and Travel Services booked through Sisterly Travel. Sisterly Travel makes no representations or warranties regarding the health or physical fitness requirements for any travel or related service.


c. If you or anyone travelling with you has any disabilities or pre-existing medical conditions which may affect travel and related services, you are solely responsible for disclosing said disabilities or medical conditions to Sisterly Travel prior to booking. You are solely responsible for providing or securing any necessary ADA, disability, or medical accommodations required to travel and engage in any services booked through Sisterly Travel. Sisterly Travel does not offer or assume any responsibility or liability for any ADA, disability, or medical accommodations that may or may not be offered by any Service Providers, and Sisterly Travel cannot guarantee the availability of any such accommodations.


d. BY OFFERING TRAVEL TO CERTAIN DESTINATIONS AND RELATED SERVICES, SISTERLY TRAVEL IS NOT REPRESENTING OR WARRANTING THAT SUCH TRAVEL OR SERVICES ARE SAFE OR FREE FROM RISK. SISTERLY TRAVEL SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES WHETHER DIRECT, INCIDENTAL OR CONSEQUENTIAL THAT MAY RESULT FROM TRAVEL OR ASSOCIATED SERVICES.



6. CHECK-IN & DEPARTURE RESPONSIBILITIES.

a. It is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure for international flights. It is the your responsibility to confirm and reconfirm flight times at least 24-72 hours prior to scheduled flights and on the day of travel for yourself and anyone traveling with you.


b. Sisterly Travel will not assume responsibility for any airline delays, TSA or security delays, or schedule changes by any travel service provider or public authority. You are solely responsible for ensuring that you and anyone traveling with you arrive at any airport, seaport, or other transit station in time to make any departure or connection.


c. Baggage, seat selection, and other fees are independently set and determined by third-party airlines, rail operators, and other transit providers. Sisterly Travel cannot guarantee and is not responsible for any baggage or seat selection fees incurred by you and anyone travelling with you during your trip.



7. TRAVEL PROTECTION/INSURANCE.

a. Sisterly Travel strongly recommends travel protection and insurance to protect your investment. Unless specifically agreed by Sisterly Travel in writing, travel insurance is NOT included in the services provided by Sisterly Travel. You are solely responsible for obtaining any travel insurance you wish to purchase to protect the cost of your trip.


b. Various travel insurance providers offer travel protection plans to protect you in the event of loss of non-refundable trip deposits and payments. Coverage under said plans is solely dependent upon the terms and conditions offered by said insurers, and is not the responsibility of Sisterly Travel. Sisterly Travel is not qualified to answer technical questions about the benefits, exclusions, and conditions of said plans, nor can Sisterly Travel evaluate the adequacy of any coverage offered or procured. Any such questions or concerns should be directed to your insurer or insurance agent or broker.


c. If you choose to travel without adequate coverage, Sisterly Travel will not be liable for any losses, howsoever arising, for which travel insurance and/or trip protection plan coverage would otherwise have been available.



8. CANCELLATION.

a. Unless otherwise noted in writing, full payment is due prior to travel according to each Service Provider’s terms and conditions. If payment in full is not received, reservations and bookings are subject to cancellation and deposits shall be forfeited. Cancelled bookings often result in assessment of additional fees by Service Providers.


b. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge. You agree to reimburse Sisterly Travel the full amount of any such additional fees or charges within 15 days of receipt from us of documentation of the fee or charge.


c. To the extent a travel service provider does offer refunds and your cancellation meets that service provider’s criteria for such a refund, we may (but are not obligated to) assist you in requesting such refund. Any such refund offered by a Service Provider is the Service Provider’s responsibility, and Sisterly Travel is not responsible for a Service Provider’s failure to offer or pay any refund. While the cost charged by a Service Provider may be recovered under some circumstances, Sisterly Travel does not issue refunds of any of its own fees for its services.


d. In the event a Service Provider cancels a product or service booked through Sisterly Travel, we may (but are not obligated to) assist you in identifying and securing alternative arrangements offered by the Service Provider, but in no event will Sisterly Travel incur further liability to you.



9. DISCLAIMERS OF LIABILITY.

a. BECAUSE SISTERLY TRAVEL ACTS SOLELY TO BOOK TRAVEL SERVICES AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF THE INDEPENDENT SERVICE PROVIDERS PROVIDING TRAVEL SERVICES, YOU AGREE SISTERLY TRAVEL IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE WHICH MAY ARISE OUT OF THESE SERVICES. SISTERLY TRAVEL IS NOT LIABLE BASED ON ANY LEGAL THEORY INCLUDING, BUT NOT LIMITED TO, CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, FOR ACTIONS TAKEN BY THE SERVICE PROVIDERS. SISTERLY TRAVEL IS HEREBY NOT LIABLE FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH THE TRAVEL SERVICES PROVIDED BY ANY SERVICE PROVIDER BOOKED THROUGH SISTERLY TRAVEL, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SERVICE PROVIDER, OR OF ANY SERVICE PROVIDER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS OUTSIDE OF SISTERLY TRAVEL’S CONTROL.


b. You agree that weather conditions, including but not limited to the presence or absence of sun, clouds, snow, sleet, hail, lightning and rainfall are not guaranteed to occur or not occur, and are clearly outside of the control of Sisterly Travel. Natural and non-natural occurring events such as volcanic eruptions, ash clouds, tornados, hurricanes, monsoons, earthquakes, wildfires, tsunamis, blizzards, snowstorms, sandstorms, flooding, and wind may be characterized as an adverse weather condition or a natural disaster by Service Providers and your travel insurance company, which is beyond the control of Sisterly Travel. Sisterly Travel reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time. Sisterly Travel shall not assume any responsibility for any air and/or ground schedule changes.


c. If your travel is extended, limited, or otherwise altered from the itinerary ofmTravel Services as booked through Sisterly Travel due to weather, flight schedules, infectious disease, or other factors beyond Sisterly Travel’s control, you will be responsible for your own hotel, transfers and meal costs. You specifically agree that Sisterly Travel is not liable for any consequential loss or damages you may incur incident to your trip or to the Travel Services.


d. Right to Refuse Service: Service Providers reserve the right to refuse service to travelers at their sole discretion and including without limitation if the traveler:

  • i. Lacks proper documentation for the country of destination;
  • ii. Has a contagious disease;
  • iii. Is under the influence of alcohol, drugs or narcotics; and/or
  • iv. Manifests disruptive and/or unruly behavior.

Sisterly Travel assumes no liability for the acts of the Service Provider in refusing service for any reason.



10. FORCE MAJEURE.

a. In no event shall Sisterly Travel be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, epidemic or pandemic disease outbreaks, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, loss or malfunctions of utilities, communications or computer (software and hardware) services, or interruptions to essential supply chains. No refunds shall be due for a decision by you or anyone travelling with you to forego travel or Travel Services out of concern for actual or threatened terrorist, health, political, military, pandemic, or other similar events.


b. Upon the occurrence of a “force majeure” event, Sisterly Travel shall use reasonable efforts which are consistent with accepted practices in the travel agent industry to resume performance as soon as practicable under the circumstances; however, if such efforts are impractical and remain so for a period of at least 30 days, Sisterly Travel may without penalty terminate the Services and shall have no further obligation to you respecting completion of the Services.



11. DISPUTE RESOLUTION,FORUM SELECTION, AND CHOICE OF LAW.

a. In the event there is a dispute or claim made against Sisterly Travel by you relating to the Services contemplated herein, Sisterly Travel may at its sole election demand the dispute be referred to mediation and, if unsettled by mediation, to binding arbitration using the Commercial Arbitration Rules of the American Arbitration Association. Any mediation or arbitration proceedings, and any litigation incident to the Services shall solely and exclusively be conducted in the geographic confines and/or the state courts of Wake County, North Carolina. By accepting our Services, you irrevocably consent to the personal jurisdictions of the district and/or superior courts of Wake County, North Carolina.


b. This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of North Carolina exclusive of conflict or choice of law rules.



12. STATUS.

a. The parties acknowledge and agree that Sisterly Travel is an independent contractor, not an agent or employee of you or the Service Providers. This Agreement shall not be construed to create a partnership, joint venture, or agency relationship between the Sisterly Travel and any other party.



13. COSTS AND INDEMNITY.

a. Customer shall indemnify Sisterly Travel for the cost and expenses we may incur in the collection of any unpaid balance of the agreed upon price for the Services that are not timely paid by the Customer under the terms specified herein or under any subsequent contract executed by the parties. Such costs and expenses shall include but are not necessarily limited to Sisterly Travel’s reasonable attorney fees incurred in such collection efforts, whether or not litigation must be filed in order to collect the aforesaid unpaid sums.


b. You agree to and shall hold harmless Sisterly Travel and each of its officers, directors, employees, and agents from any expenses, losses, liabilities, damages, judgments, settlements and costs involved with or incurred by Sisterly Travel with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from (a) your breach or violation or threatened breach or violation of this agreement, and (b) any damage caused by you in connection with your trip and any Travel Services.



14. ENTIRE AGREEMENT.

a. This document, together with any specifications, proposals, quotes or other documents made a part hereof by attachment or incorporation shall constitute the entire agreement between the parties


b. The Terms and Conditions that govern the provision of the Services are limited to the terms and conditions specified herein, and formation of any contract is expressly made conditional on your assent to these terms. These Terms and Conditions supersede all prior discussions, proposals, representations, and agreements. Sisterly Travel will not be bound by any additional, different, or inconsistent terms in acknowledgements, invoices, emails or other documents from you or by any course of conduct between the parties. If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the remainder of the Agreement and shall not affect the validity and enforceability of any remaining provisions.
